Extension to Obtain Spanish Nationality under the Democratic Memory Law

During the Council of Ministers on Tuesday, July 9, the extension to apply for Spanish nationality under the Law of Democratic Memory until October 22, 2025 was approved.

This measure benefits those born outside Spain, descendants of exiles for political, ideological or sexual identity reasons.

The eighth additional provision of Law 20/2022, of October 19, on Democratic Memory, established a term of two years to opt for Spanish nationality from its entry into force, on October 21, 2022, which expired on October 20, 2024. The approved Royal Decree-Law extends this period until October 22, 2025.

This extension is a relevant measure for persons born outside Spain, children or grandchildren of Spaniards exiled for political, ideological or belief or sexual identity and orientation reasons. This extension will facilitate access to Spanish nationality for those who have not yet initiated the process or have not been able to complete it within the initial deadline.

The extension of the deadline for acquiring Spanish nationality under the Law of Democratic Memory was approved by the Council of Ministers through a Royal Decree-Law that includes other measures related to the Law of Democratic Memory.

The Government has considered the need for this extension to allow a greater number of people to benefit from this legal provision that recognizes and redresses the injustices of the past.

The Law of Democratic Memory, in its eighth additional provision, establishes that persons born outside Spain of exiled Spanish parents or grandparents who lost or renounced Spanish nationality as a result of exile may also acquire Spanish nationality.
